COLUMBUS, Ohio — A Delaware County grand jury has indicted a Columbus Alternative High School teacher who admitted to taking videos of female students for the past seven years.
Justin Foley, 47, is charged with 10 counts of unlawfully using an underage or impaired person in material or performances that focus on nudity, according to Delaware County Court of Common Pleas documents.

The Delaware Police Department received a tip in August from the Ohio Internet Crimes Against Children Task Force, according to court records.
The tip involved a Google account owned/operated by Foley. The account contained 46 files of alleged child pornography images, several of which were of teenage girls between the ages of 12 and 16.
Court documents say Google produced the full account data and authorities were able to identify more than 5,000 images of child pornography and 166 video files of a voyeuristic nature.
The videos were apparently recorded in department stores around Columbus, public areas downtown, near Ohio Wesleyan University, downtown Delaware and outside Conger Elementary School.
On September 20, law enforcement questioned Foley, who admitted to downloading and transferring the images to an external hard drive and then uploading them to the Google account.
Foley also admitted that he still actively produced voyeur videos in public places and taught high school, court records added.
Foley said he has been recording “up-skirt” type videos of students at his school for seven years and as recently as two weeks ago.
The state recommended $250,000 bond for Foley in addition to lack of internet access, lack of contact with minors and GPS surveillance.
Columbus City Schools said Foley is a science/AP teacher and has worked in the district since 2013. The following statement was sent to 10TV by the district:
“Columbus City Schools has a strict code of conduct that all employees must follow. We take this matter very seriously as we are committed to the safety and well-being of our students. I can confirm that the District is aware of Mr. Foley’s arrest as part of a police investigation, and we are cooperating with law enforcement. I can also tell you that the teacher has been suspended and will not be returning to our district. We have started the process of recommending his dismissal.
